 VSY Biotechnology to Appeal IOL Patent Ruling

VSY Biotechnology B.V. reportedly plans to appeal a recent judgement in a patent infringement suit regarding a trifocal intraocular lens (IOL).

Last week, Carl Zeiss Meditec AG had reported the District Court of Düsseldorf/Germany had ruled in their favor and against VSY Biotechnology and its exclusive distribution partner Fritz Ruck Ophthalmologische Systeme GmbH, ruling the trifocal intraocular lens offered by these companies infringes the European patent EP 2377493 B1 of Carl Zeiss Meditec. 

According to a press release issued today by VSY Biotechnology, the ruling was by the German Court of First Instance, and the company has the right to and will appeal the judgement with the Higher District Court and, if necessary, the Federal Supreme Court in Germany.

VSY Biotechnology also reported it had applied for invalidation of Zeiss Patent EP 2 377 493 B1 before the European Patent Office (EPO) on May 6, 2016, with the claim the Zeiss patent did not fulfill requirements of patentability.
